The term "Contract" means the sales contract concerning the products / services indicated and offered for sale on the 47 Anno Domini Website, stipulated between them and the Customer in the context of sales at a distance through telematic tools, organized by 47 Anno Domini.
The term “Customer” means the consumer who is an individual person who makes the purchase, referred to in this Agreement, for purposes not related to any commercial or professional activity of his own.
The term “47 Anno Domini” means those responsible for the sale of the goods covered by this contract. 47 Anno Domini, which sells the Products, is Società Agricola 47 A.D. S.s. with legal headquarters and operations in Via Treviso Mare 2, 31056, Roncade (TV), p.iva 03384780262.
The term “Product” means the goods and / or services covered by this Agreement and put up for sale for 47 Anno Domini.
The term “Website” means the platform on which 47 Anno Domini Products are displayed and offered for sale. The Website refers to www.47annodomini.it.
Parties to the Agreement and access to the online purchasing service for the Products
The products are offered for sale by 47 Anno Domini under the conditions of this Agreement.
The customer expressly declares to make the purchase for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.
Access to the online purchase service of the Products is allowed only to adults by means of a tick through which the Customer declares that he is of age.
It is expressly forbidden for the Customer to enter false and / or invented data in the registration procedure necessary to activate the execution process of this Agreement and related further communications; the personal data transmitted by the Customer must correspond to their real personal data and not those of third parties or real or invented. It is expressly forbidden to make multiple registrations corresponding to the same person or to enter data of third parties.
47 Anno Domini disclaims any liability to the Customer arising from the issue of incorrect tax documents due to errors in the data provided by the Customer, the Customer being solely responsible for the correct entry. It is understood that 47 Anno Domini cannot be held liable under any circumstances to the Customer and / or third parties for the abusive use of the Password and, in general, of the online purchase service through the Website by unauthorized third parties.
47 Anno Domini reserves the right to legally pursue any violation and abuse, in the interest and for the protection of consumers.
Object and conclusion of the Agreement
With this Agreement, 47 Anno Domini sells to the Customer, who buys remotely through the Website. The Contract between 47 Anno Domini and the Customer is concluded exclusively through the Internet by the Customer accessing the Website address where, by following the procedures indicated in the appropriate registration section (link), the Customer will formalize the proposal for the purchase of the Products offered for sale through the Website itself.
The purchase contract is concluded through an order from the Customer who fills in and submits the online purchase order form for the Product, which will be displayed on the order summary web page. The printable order summary is sent by e-mail from 47 Anno Domini to the Customer, and shows the Customer's details, the purchase order, the price of the Products purchased and any shipping costs, methods and terms payment and the address where the product will be delivered.
The Contract is considered finalized and effective between the parties only with the execution of the order and the issue of the related invoice by 47 Anno Domini, having had the possibility, up to that moment, to refuse the order. The sales document will be issued by 47 Anno Domini in paper form and placed inside the package containing the ordered Products.
Payment and refund methods
47 Anno Domini accepts payment for Products ordered by major credit cards (Mastercard and Visa circuits), Pay Pal and Satispay.
The Credit card data is managed directly by credit institutions and / or financial companies specialized in the management of online payments. The information is encrypted to prevent its use by third parties and is sent directly to the bank.
After the conclusion of the electronic product purchase process, 47 Anno Domini will process the order and deliver the Products, as long as there are no further impediments.
Where the conditions apply, any refund to the Customer will be made by reversing the payment by credit card, within 14 days from the date on which 47 Anno Domini became aware of the cause that generated the right to refund.
Times and methods of Product delivery
For deliveries in Italy, order processing times may vary from 1 to 7 working days. For deliveries to European Union countries, the order fulfilment times may vary from 3 to 14 working days. For countries outside the European Union, order processing times can vary from 5 to 30 working days.
Order processing times start from the receipt of payment for the goods by 47 Anno Domini.
In the event that 47 Anno Domini is not able to ship the Products ordered within this deadline, prompt notice will be given by e-mail and / or telephone to the Customer, indicating the deadline within which it will be processed.
It is understood that delivery times may vary according to the country of destination and other factors that do not depend on the will of 47 Anno Domini.
Transport and Product delivery costs
47 Anno Domini ships with the DDP (Delivery Duty Paid) formula to EC countries, therefore in these destinations the ordered Products will arrive directly at the place of delivery indicated by the Customer in the order request, without the latter having to pay additional sums to that paid at the time the order is placed. For all other countries, the DDU (Delivery Duty Unpaid) formula is used, therefore, upon delivery of the Products, the courier may present to the Customer a separate invoice for payment of duties and taxes required by the local authorities.
Insurance of the goods and liability arising from transport
47 Anno Domini will entrust the carrier with goods perfectly intact and corresponding to the order.
It remains in any case understood that 47 Anno Domini is not responsible for any delay in order fulfilment or delivery of the Products due to the carrier and for any damage caused to the goods during transport.
On delivery of the Product by the courier, the Customer is responsible for checking:
- that the quantity of Products delivered corresponds to that indicated in the order confirmation sent by e-mail before shipment and on the carrier's delivery note;
- that the Product or packaging is intact, not damaged, wet or altered.
In case of any anomaly found, the Customer should not accept the goods and will have to raise the complaint directly with the carrier, specifying which discrepancies he has found. In the absence of this declaration, the Customer will be unable to raise further complaints about the existence of obvious defects in the Products delivered.
All the sales prices of the Products displayed and indicated on the Website are expressed in euros (€) and constitute an offer to the public pursuant to art. 1336 c.c.. They include VAT and all other taxes regarding delivery within the territory of a country of the EU.
For deliveries to non-EU countries, as specified in point 6.1., the courier may request additional amounts from the customer for local taxes and duties.
Shipping costs will be indicated and calculated in the Product purchase procedure before the Customer completes the order and also contained in the summary web page of the order placed.
Prices indicated for each of the Products offered to the public are valid until the time the purchase order is sent and indicated on the order summary web page. It is understood that the prices of the Products may be changed unilaterally and at any time from 47 Anno Domini, notwithstanding the fact that the price of the Product indicated on the web page and in the order summary e-mail will be binding between 47 Anno Domini and the Customer.
47 Anno Domini ensures, through the electronic system used, the processing and fulfilment of purchase orders for the Products. The 47 Anno Domini computer system sends the Customer purchase order registration confirmation by e-mail, which does not however result in any legal obligation, being a simple summary of the order.
If a purchase order should exceed the quantity of Products available in the warehouse, 47 Anno Domini, by e-mail and / or telephone communication, will notify the Customer of the unavailability of the Products or the waiting times, asking, in the latter case, whether the Customer intends to confirm the order or not.
Supplier responsibility limitation
47 Anno Domini assumes no responsibility in the event that it fails to execute the order within the time frame provided for in the Contract caused by inefficiencies due to unforeseeable circumstances or force majeure.
47 Anno Domini cannot be held responsible by the Customer, except in the case of wilful misconduct or gross negligence, for disservices or malfunctions connected to the use of the Website, independent of the will of 47 Anno Domini, its collaborators and/or its sub-suppliers, which go beyond reasonable predictability and which cannot be remedied without precautions exceeding those of average diligence.
The Customer has no right to compensation or damages, nor to demand any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order by 47 Anno Domini.
47 Anno Domini assumes no responsibility for any fraudulent or illegal use that may be made by third parties of the credit cards used for the payment of the purchased Products, if it proves that it has adopted all the ordinary precautions possible at the time and on the basis of ordinary diligence.
Liability for defects in the Products, proof of damage and refundable damages
47 Anno Domini cannot be held responsible for any direct and/or indirect, contractual and/or extra-contractual damage suffered by the Customer deriving from defects of the Product, if the defect is due to the conformity of the Product, to an imperative legal rule or a binding provision, or if the state of scientific and technical knowledge at the time in which the manufacturer placed the Product on the market, did not yet allow the Product to be considered as defective.
It remains understood that no compensation will be due if the Customer is aware of the defect of the Product and of the resulting danger and nevertheless has voluntarily exposed himself to such danger.
In any case, the burden of proof lies with the Customer for the defect of the purchased Product, the damage and the causal connection between defect and damage suffered. The Customer is aware of the fact that the Products ordered are described and photo-reproduced on the Website, and therefore accepts the normal differences and colour distortions of the Products that will be delivered compared to the Products viewed on the Website. Colour of the products as seen on the monitor may differ from the colour of the product itself.
Customer Guarantee - Returns
47 Anno Domini is liable for any ascertained defect found in the Product, always if attributable to the same, provided that such defect has been reported by registered letter with return receipt to 47 Anno Domini, via Treviso Mare 2, 31056, Roncade (TV) Italy, or, by e-mail at firstname.lastname@example.org within 8 days of delivery of the Product.
47 Anno Domini reserves the right to request from the Customer photographic evidence of the Products that are alleged to be defective before authorizing returns and/or exchanges.
47 Anno Domini does not accept exchange and/or return requests regarding Products that have been tampered with or otherwise altered by the Customer.
If products are defective 47 Anno Domini will bear the transport costs necessary to return the products to their warehouse. However, the Customer will be responsible for insurance of the transport of the goods returned for exchange at 47 Anno Domini. In the event of theft or loss of the returned Products, which occurred during transport to 47 Anno Domini, no refund will be made.
47 Anno Domini will not accept returns of customised Products (e.g., with personalised labels).
Once the online purchase procedure is completed, the Customer undertakes to print and keep these general conditions of sale, as well as the specifications of the Product being purchased.
The Customer undertakes to pay the price of the purchased Product within the time and by methods indicated in the Contract.
Right of withdrawal
The customer has the right to withdraw from this contract in accordance with D. Lgs. 21/02/2014 n. 21 within 14 (fourteen) days from the date of despatch of the purchase order.
If the Customer makes use of the right of withdrawal, they must notify 47 Anno Domini by PEC at the address email@example.com.
In any case, in order to exercise the right to reimburse the price of the Product, the Customer must return the Product intact in its original packaging and not used or tampered with.
The Customer acknowledges that the right of withdrawal cannot be exercised in relation to Products ordered by the Customer that have customized packaging.
The only costs payable by the purchaser for exercising the right of withdrawal, pursuant to this article, are those of transporting the Product to 47Anno Domini.
Products not returned according to the aforementioned methods will not be accepted by 47 Anno Domini and, consequently, not refunded. It is understood that in the event of a right of withdrawal, 47 Anno Domini is not responsible for the theft or loss of the Products during the transport of the goods to 47Anno Domini.
If the Customer exercises the right of withdrawal, 47 Anno Domini will refund the price of the Product, within 14 days of receipt of the notice of withdrawal, provided that within this period the goods have been returned in the condition and by the methods indicated in this article. The Customer must send the returned goods to the following address: 47 Anno Domini, Via Treviso Mare, 2 – 31056, Roncade (TV) – Italia.
Customer's Confidentiality and Personal Data Protection
47 Anno Domini protects the privacy of its Customers and guarantees that data processing is carried out in accordance with the European Regulation on the processing of Personal Data (EU) 2016/679 and the Italian Privacy Code in force (D.Lgs. 196/2003 and successive D.Lgs. 101/2018).
Method of archiving the Contract
Pursuant to Article 12 of Legislative Decree 70/03, 47 Anno Domini informs the Customer that each order sent is stored in digital form on the server that hosts the Website according to confidentiality and security criteria.
Communications and Complaints
Communications written directly to 47 Anno Domini and any complaints will be considered valid only if sent to the address 47 Anno Domini, Via Treviso Mare, 2 – 31056, Roncade (TV) – Italia, or sent by email to the PEC address: firstname.lastname@example.org.
The Customer indicates on the registration form on the Website their residence, the telephone number or e-mail address at which they wish to receive communications from 47 Anno Domini.
It is understood that all communications from the Customer (such as for example but not limited to: requests, suggestions, ideas, information, materials, etc.) that may be sent to the email address (email@example.com ) of 47 Anno Domini will not be considered information or data of a confidential or reserved nature.
The aforementioned communications may not contain contents that directly or indirectly contravene the laws or regulations in force of the Italian State or any other State and may not in any case: (i) violate the rights of third parties; (ii) contain information that is harmful to the rights of third parties and / or that is untrue, it being understood from now on that no responsibility can be attributed to 47 Anno Domini with regard to the content, lawfulness, nature, quality and truthfulness of the information included in said communications from the Customer.
Competent Court - Online platform for alternative dispute resolution (ODR)
Pursuant to art. 63 of Legislative Decree 6 September 2005, n. 206, all disputes concerning the validity, interpretation, execution, effectiveness of this Agreement will be devolved to the jurisdiction of the Court of the place of residence or domicile of the Customer. This contract is regulated by the Italian law.
Without prejudice to the provisions of point 11.1, the Customer is informed that, pursuant to EU Regulation no. 524/2013 and Legislative Decree 6 August 2015 n. 130, an online platform for the resolution of ODR disputes (online dispute resolution) arising from the online purchase of goods was established by the European Commission, accessible via the following link: http://ec.europa.eu/consumers/odr/.
Effectiveness of the Agreement
Confirmation of the purchase order for the Products implies that the Customer accepts these general terms and conditions. These general terms and conditions may be updated and/or modified unilaterally by 47 Anno Domini and will be valid from the date of publication on Website.
